PROCESSING OF PERSONAL DATA
The use of our website is usually possible without providing personal information. Processing of your data for the purpose of personnel search, selection and recruitment will not take place until we include you in our database. If you are not included in our database, your contact information will be deleted in our system. We will inform you about this at the given time via e-mail.
MEASURES TO SAVE STORED DATA
If we collect personal data, we store it on specially protected servers in Germany. Access to it is only possible for a few specially authorized persons who are involved in technical, commercial or editorial support. In order to avoid loss or misuse of the data, we take extensive technical and organizational measures, which are regularly reviewed and adapted to technical progress. However, please note that due to the structure of the internet, it is possible that the rules of data protection and the above-mentioned safety measures may not be regarded by persons wo are not in the area of responsibility. In particular, unencrypted disclosed data – even if this is done by e-mail – may be read by third parties. Internet-based data transmissions can in principle have security gaps, so that absolute protection cannot be guaranteed by us. For the transmission of information with high secrecy need we recommend the post office. Our security measures are continuously improved in line with technological developments.
SPECIFIC INFORMATION ABOUT THE PROCESSING OF PERSONAL DATA
We process personal data that we have collected in the context of our search request for person-seeking companies for the purpose of personnel search, selection and placement. These personal data may originate directly from the conversation with you, may have been provided by you for the purpose of personnel and job placement online via social media services (e.g. Facebook, Google, Xing, LinkedIn, etc.) or from publicly accessible sources on the internet. In individual cases we receive your contact data by a personal recommendation.
Note: When processing your data, we follow the privacy principles, in particular the principles of purpose, integrity and confidentiality, and process only that personal information that may be relevant to your qualification for a particular managerial or similar management position.
DATA CONCERNED
The relevant personal data relate in particular to your contact data (first and last name, telephone number, mobile number, e-mail address) as well as information relevant to the position to be filled (current sector, company level, position function, department, employer). In addition, the following information may also be processed: date of birth and place of birth, address, CV and bibliographical data, career information, data on your suitability for vacancies with clients we compile as part of our professional profile assessments, information about your private and professional lives publicly available through social media services (e.g., Facebook, Google, LinkedIn, Xing, etc.) or otherwise available on the internet who may be relevant to your qualification for a particular managerial or similar management position, and to us for your particular personal information previously disclosed.
PURPOSE OF PROCESSING
Processing by our company takes place exclusively for the purpose of a possible staffing in the context of current and future search orders. As part of our client’s search request, your candidate information can be processed for the following purposes:
- Conducting searches for potential candidates on behalf of clients who have a vacancy at a specialist, management or similar management position,
- to operate the database where your candidate information is stored,
- to inform you about potential specialist, management or similar management positions that may be suitable for you,
- assessment of your suitability for vacant positions with clients,
- to introduce you to clients as candidates,
- to contact you, for example, to make an appointment with you for a personal interview,
- researching information about your private and professional life that is publicly available through social media services (e.g. Xing, LinkedIn, Facebook, Google, etc.) or available on the internet, or that results from the information you have previously disclosed to us, as far as this information could be relevant to your qualification for a particular management or similar management position,
- contacting you after you have been hired by a client, as a point of contact for clients hiring other candidates, or as a source of information for potential third-party candidates,
- to verify your educational records, professional qualifications and certificates,
- to make sure that, after you have been hired by a client, you are not asked to be considered for other vacancies on behalf of one of our other clients, unless you don’t want to be considered for other vacancies.
LEGAL BASIS
Legal basis: To safeguard legitimate interests in the context of balancing interests
If processing is necessary to safeguard the legitimate interests of our company or a third party, and if the interest, fundamental rights and freedoms of the data subject do not prevail over the first interest, Art. 6 para. 1 p. 1 lit. f) GDPR as legal basis for processing. A legitimate interest may exist in particular:
- In the conduct of our business and that of the client. In order to be able to fulfil our business purpose of personnel search, personnel selection and personnel placement, it is necessary to contact the candidate / contact person of the person seeking company and using information to contact. There is no conflicting interest on the part of the person concerned because we only use publicly available data or data provided by the candidate / contact person of the person seeking company for the purpose of establishing professional contacts, so that a purpose limitation exists,
- For the storage of contact information of the candidate / contact person of the person seeking company, to fulfil our obligation to inform, inform and delete the relevant personal data.
- In pursuit of our business interests, to improve our performance to attract early candidates for suitable specialist, management, or similar management positions.
Legal basis: Based on your consent
The use of personal data on the basis of a legal permit is carried out in particular in connection with the fulfilment of contractual obligations in accordance with Art. 6 para. 1 sentence 1 lit. c) DSGVO of Reck & Matić Executive Search GbR towards the person-seeking clients within the scope of the search mandate.
Legal basis: For the fulfillment of contractual obligations
The use of personal data on the basis of a legal permit is carried out in particular in connection with the fulfilment of contractual obligations in accordance with Art. 6 para. 1 sentence 1 lit. c) DSGVO of Reck & Matić Executive Search towards the person-seeking clients within the scope of the search mandate.
Legal basis: Due to legal requirements
In addition, as a company, we are subject to various legal obligations, cf. Art. 6 para. 1 sentence 1 lit. c) GDPR, i.e., legal requirements (e.g. Banking Act, Money Laundering Act, Securities Trading Act, tax laws) and supervisory requirements (e.g. the European Central Bank, the European Savings Banks Supervisory Authority, the Deutsche Bundesbank and the Federal Financial Supervisory Authority). In particular, in the case of a successful mediation, it may therefore be necessary to store personal data in accordance with the statutory periods, insofar as these data are relevant for settlement as a posting document and for fulfilling the retention obligations.
RECIPIENT OF THE DATA
Your personal data is available through our database exclusively to our employees for the purpose of providing the search request. Access by unauthorized third parties is denied by appropriate technical and organizational measures. We have concluded a contract with our software service provider for the process of order data processing. This ensures that our service provider adheres to the strict requirements of German data protection law in all respects when processing your personal data. This also ensures that your data is stored only within the EU with a high level of protection. There is no storage of your data on servers outside the EU. Your data will only be passed on to our clients after consultation with you if you are interested in an offered position. A transfer of data to third parties for other purposes, for example to advertise or sell the addresses, we expressly exclude.
THIRD COUNTRY TRANSFER
There is no transfer of data to third countries (states outside the European Economic Area – EEA) or to international organizations. Most of our clients are based in Germany but not outside the EEA.
INFORMATION STORAGE
By granting your consent to the processing of your personal data, you give us your consent to process your data until further notice. If we do not receive any feedback from you, your personal data will be deleted after expiration of the search order for the vacant position in our database. If you object to the processing, revoke your consent or the processing is no longer necessary to fulfill the purpose of the storage, we will delete your data in accordance with. Art. 17 DSGVO without delay, insofar as the processing is not required for the assertion, exercise or defense of legal claims and fulfillment of statutory retention requirements, cf. Art. 17 para. 3 lit. e) GDPR.
